Bankruptcy Basics
The bankruptcy process, although no walk in the park, is not as forbidding and time-consuming as you may have heard. If successful, you can achieve your debt relief goals with relatively little time and trouble.
The basic steps are:
- Filing the bankruptcy petition: This will enact the automatic stay, which stops lawsuits, garnishment, foreclosure and other creditor actions.
- In 30 to 45 days, meet with the bankruptcy trustee at the 341 meeting: In this meeting, the trustee may ask you questions about your debt and personal finances. Although it is called a Meeting of Creditors, creditors rarely show up.
- If you are filing Chapter 7, the trustee will sell any qualifying assets you own for the benefit of the creditors. (Most people who file for Chapter 7 have no qualifying assets.)
- 60 days after filing Chapter 7, debt is discharged.
- If you are filing for Chapter 13, a payment plan will be established. You will pay a set amount each month over a three to five year period, based on what you can afford.
