  • Do I have to be a U.S. citizen to file for bankruptcy? No, you do not. You simply have to be a legal resident. You do have to establish your identity, however, and can do so with a Social Security card or Individual Taxpayer Identification Number (ITIN). You also have to have lived in the area you are filing for a minimum of 180 days.
  • Will filing for bankruptcy hurt my chances at becoming a naturalized citizen? There is no law forbidding people who have filed for bankruptcy from applying for citizenship. There is a question on the N-400 Application for Naturalization as to whether an applicant has failed to pay any taxes. If you answer "yes" to this question, it may have an impact on your immigration status.
