Have You Filed for Bankruptcy More Than Once?
While you can file for bankruptcy as many times as you want, there are waiting periods involved in the actual discharge of debt. The following are the waiting periods for Chapter 7 and Chapter 13 bankruptcy:
- From Chapter 7 to Chapter 7: 8 years
- From Chapter 7 to Chapter 13: 4 years
- From 13 to 7: 6 years (unless all creditors were paid in the first Chapter 13, in which there is no time stay)
- From 13 to 13: 2 years
The automatic stay is also affected by multiple filings. If you have had a bankruptcy case dismissed within the last year, the automatic stay will only last for 30 days. If you have had more than one bankruptcy dismissed in the past year, the automatic stay will not go into effect at all.
